1. INTRODUCTION

These Terms and Conditions govern your access to and use of Place2Stay.co.za and related services made available by Let's Trade 1350CC trading as Place2Stay.

Place2Stay is an online advertising platform for rental property and student accommodation. We connect landlords, accommodation providers, students, and tenants. We do not act as an estate agent, property inspector, compliance authority, or party to any lease.

By creating an account, listing a property, expressing interest in a property, or otherwise using the Platform, you agree to these Terms.

If you do not agree, you must stop using the Platform.

2. DEFINITIONS

In these Terms:

  • "Platform" means Place2Stay.co.za and its related services and features.

  • "Place2Stay", "we", "us", or "our" means Let's Trade 1350CC trading as Place2Stay.

  • "User" means any person or entity using the Platform.

  • "Landlord" includes an owner, company, trust, authorised representative, or other accommodation provider who advertises property on the Platform.

  • "Student" means a user seeking student accommodation.

  • "Tenant" means a user seeking a normal rental or non-student accommodation.

  • "Listing" means any property advertisement or related listing content published on the Platform.

  • "Personal Information" has the meaning assigned in POPIA.



3. WHAT PLACE2STAY DOES

Place2Stay provides a digital marketplace that allows users to:

  • search for rental property and student accommodation

  • save and compare listings

  • view listings on an interactive map

  • contact landlords or express interest in a property

  • publish rental listings

  • manage listing content and account information


3.1 What Place2Stay is not

Place2Stay is not:

  • an estate agent or property practitioner acting in the transaction

  • a party to any lease agreement

  • a holder of rental deposits between landlord and tenant

  • a property inspector

  • a municipal or regulatory compliance authority

  • a guarantor of property condition, legality, or suitability


3.2 No professional advice

Place2Stay does not provide legal, property, compliance, tax, or financial advice. Users must obtain independent professional advice where needed.


4. ELIGIBILITY AND ACCOUNTS

To use account-based features, you must register and provide accurate, current, and complete information.

You are responsible for:

  • maintaining the confidentiality of your login credentials

  • all activity under your account

  • promptly updating inaccurate or outdated account information


If you are under 18, you may only use the Platform where permitted by law and, where required, with the consent of a parent or legal guardian.


5. LANDLORD VERIFICATION AND LISTINGS

5.1 Minimum landlord verification

Before a landlord listing goes live, Place2Stay may require evidence sufficient to verify:

  • the identity of the landlord or authorised representative

  • the landlord's authority to advertise the property

  • any special badge or claim the landlord wants shown publicly on the listing


Examples of documents that may be accepted include:

  • South African ID or Smart ID

  • passport and valid permit where applicable

  • CIPC registration documents

  • trust deed and Master's Letter of Authority

  • title deed

  • recent municipal rates account

  • signed owner mandate

  • supporting proof for a special badge or claim


5.2 Optional supporting documents

Landlords may choose to upload additional supporting documents, including compliance-related or municipal documents. These optional uploads may assist internal review or support specific claims, but they do not change Place2Stay into an inspector or certifier.

5.3 No compliance certification by Place2Stay

Place2Stay does not certify:

  • municipal compliance

  • zoning compliance

  • safety compliance

  • building condition

  • habitability

  • lease fairness


Any optional document uploaded by a landlord remains the landlord's responsibility.

5.4 Listing accuracy

Landlords must ensure that all listing information is accurate, current, and not misleading, including:

  • photographs

  • rent and deposit figures

  • description and features

  • availability

  • property type

  • room counts

  • special claims or badges


5.5 Place2Stay rights

We may:

  • request additional information

  • refuse, suspend, edit, unpublish, or remove a listing

  • suspend or terminate an account

  • remove a badge or claim where proof is missing, outdated, or unclear



6. STUDENTS, TENANTS, AND ENQUIRIES

Students and tenants may browse, save, compare, and enquire about listings.

When a user expresses interest in a listing:

  • the landlord may receive limited profile and contact information necessary to respond

  • the landlord and tenant or student deal directly with each other after that point


6.1 Place2Stay's limited role

Place2Stay does not:

  • negotiate leases

  • sign leases on behalf of users

  • collect deposits or rent on behalf of landlords

  • guarantee that a landlord will respond

  • guarantee that a tenant or student will secure a property

  • guarantee the outcome of any transaction or tenancy



7. USER RESPONSIBILITIES

All users must:

  • provide truthful information

  • use the Platform lawfully

  • not impersonate others

  • not upload forged, altered, or misleading documents

  • not publish false, deceptive, or discriminatory content

  • not use the Platform for fraud or unlawful activity


7.1 Tenant and student due diligence

Before signing any lease or paying any money, a student or tenant must:

  • inspect the property in person where reasonably possible

  • verify all material facts independently

  • review the lease carefully

  • satisfy themselves that the property and arrangement are acceptable


7.2 Landlord responsibility

Landlords remain fully responsible for:

  • their authority to advertise

  • the accuracy of their listing

  • the condition and legality of the property

  • interactions with prospective tenants

  • compliance with applicable law



8. FEES

Any fees applicable to landlords or other paid services will be displayed on the Platform or pricing page.

Unless a law requires otherwise or Place2Stay states otherwise in writing:

  • fees are payable as stated at the time of purchase

  • fees are generally non-refundable once the relevant paid service has been provided or activated


Nothing in this section overrides any non-waivable rights under South African law.


9. PRIVACY AND POPIA

Place2Stay processes personal information in accordance with POPIA and the Place2Stay Privacy Policy.

Personal information may be processed for:

  • account creation and management

  • identity verification

  • authority-to-advertise verification

  • fraud prevention

  • support

  • listing publication

  • search and enquiry functionality

  • service improvement

  • legal compliance


Where a landlord uploads verification or supporting documents, the landlord consents to that processing for these platform purposes.


10. INTELLECTUAL PROPERTY

Place2Stay and its licensors retain all rights in the Platform, including branding, software, layout, design, and proprietary content.

Users retain ownership of content they submit, but grant Place2Stay a non-exclusive licence to use, store, display, reproduce, and adapt that content as reasonably necessary to operate, market, and improve the Platform.

Users warrant that they have the necessary rights to submit the content they upload.


11. DISCLAIMERS

The Platform is provided on an "as is" and "as available" basis to the extent permitted by law.

Place2Stay does not warrant:

  • uninterrupted or error-free access

  • that listings are complete, accurate, or lawful

  • that any landlord or tenant will behave lawfully or honestly

  • that any property is safe, compliant, or suitable

  • that a special badge or claim will remain valid indefinitely


Verification by Place2Stay means only that Place2Stay completed its own platform verification steps based on information available to it at the time. It is not a guarantee of trustworthiness, ongoing compliance, or property quality.


12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Place2Stay is not liable for:

  • disputes between landlords and tenants or students

  • losses arising from inaccurate listing information supplied by users

  • deposits, rent, lease disputes, cancellations, or refunds between users

  • property condition, maintenance, compliance, or legality issues

  • user fraud, misrepresentation, or unlawful conduct

  • indirect or consequential loss


Where liability cannot lawfully be excluded, Place2Stay's aggregate liability is limited to the lesser of:

  • the amount paid by you to Place2Stay in the 12 months before the claim, or

  • ZAR 5,000


This does not limit any rights that cannot lawfully be excluded under South African law.


13. INDEMNITY

You agree to indemnify and hold harmless Place2Stay, Let's Trade 1350CC, and their owners, employees, contractors, and agents against claims, losses, damages, liabilities, costs, and expenses arising from:

  • your use of the Platform

  • your listings or uploaded documents

  • your breach of these Terms

  • your breach of law

  • disputes between you and another user

  • fraud, misrepresentation, or unlawful conduct by you



14. SUSPENSION AND TERMINATION

Place2Stay may suspend, restrict, or terminate accounts or listings where:

  • these Terms are breached

  • false information or false documents are submitted

  • fraudulent or suspicious conduct is suspected

  • a listing creates legal, operational, or reputational risk

  • required fees are unpaid

  • removal is required by law


Users may request account closure by contacting support@place2stay.co.za, subject to legal retention obligations.


15. DISPUTES

Place2Stay encourages users to first raise concerns with support@place2stay.co.za.

However:

  • landlord-tenant disputes remain primarily between those parties

  • users may also approach the Rental Housing Tribunal or other competent authority where applicable


These Terms are governed by South African law.


16. GENERAL

  • If any provision is invalid, the remainder remains enforceable.

  • Place2Stay may update these Terms from time to time.

  • Material changes may be communicated by email, in-product notice, or publication on the Platform.

  • Continued use after an update constitutes acceptance of the revised Terms.
