1. PURPOSE
This document explains important disclaimers and limitations that apply when you use Place2Stay.
It must be read together with the Place2Stay Terms and Conditions and Privacy Policy.
2. PLATFORM ROLE
Place2Stay is an advertising platform for rental property and student accommodation.
Place2Stay is not:
- an estate agent acting in the deal
- a party to any lease
- a property inspector
- a municipal or regulatory compliance authority
- a guarantor of landlord conduct
- a guarantor of tenant conduct
- a holder of deposits or rent between users
Place2Stay provides search, listing, map, save, and enquiry functionality only.
3. NO PROFESSIONAL OR COMPLIANCE ASSURANCE
Place2Stay does not provide legal, engineering, safety, compliance, valuation, or inspection services.
Place2Stay does not guarantee:
- property condition
- municipal compliance
- zoning compliance
- electrical, gas, or fire compliance
- habitability or suitability
- lease fairness
- future availability of a property
If a landlord uploads optional supporting documents, that does not mean Place2Stay has certified the property or assumed responsibility for the property.
4. LISTINGS, BADGES, AND VERIFICATION
4.1 Listings
Listing information is largely supplied by landlords and other users.
Place2Stay does not guarantee that listings are:
- complete
- accurate
- current
- lawful
- free from misrepresentation
4.2 Verification
Where Place2Stay verifies a landlord, Place2Stay is verifying only its own platform criteria, such as:
- identity
- apparent authority to advertise
- selected listing claims or badges where proof is required
This verification is not a guarantee of:
- trustworthiness
- legal compliance
- property quality
- ongoing status
- future conduct
4.3 Badges and special claims
Where Place2Stay displays a badge or special claim, it reflects Place2Stay's platform review of information available to it at that time. It is not a warranty, legal certification, or guarantee.
Users must still do their own checks.
5. TENANT AND STUDENT RESPONSIBILITY
Before signing a lease or paying any money, tenants and students must:
- inspect the property in person where reasonably possible
- verify material facts themselves
- review lease terms carefully
- confirm the identity of the person they are dealing with
- satisfy themselves that the property and arrangement are acceptable
Place2Stay is not responsible for a user's decision to enter into a rental arrangement.
6. LANDLORD RESPONSIBILITY
Landlords remain solely responsible for:
- authority to advertise
- listing accuracy
- uploaded documents
- the property itself
- compliance with law
- tenancy conduct and dealings with prospective tenants
If a landlord provides false, forged, misleading, or outdated information, that responsibility remains with the landlord.
7. THIRD-PARTY CONDUCT AND CONTENT
Place2Stay is not responsible for:
- the conduct of landlords, tenants, students, or other users
- disputes between users
- off-platform communications or transactions
- third-party websites or services linked from the Platform
- decisions made by users based on content, listings, or communications
8. NSFAS AND SPECIAL SCHEMES
Place2Stay may display NSFAS-related information or claims where users supply supporting information.
Place2Stay:
- is not NSFAS
- does not guarantee NSFAS funding outcomes
- does not guarantee accreditation outcomes
- does not guarantee payment or allowance outcomes
- does not replace confirmation from NSFAS or institutions
Users must confirm critical NSFAS matters directly with the relevant institution or authority.
9. TECHNICAL DISCLAIMER
The Platform is provided on an "as is" and "as available" basis to the extent permitted by law.
Place2Stay does not guarantee:
- uninterrupted availability
- error-free operation
- compatibility with all browsers or devices
- freedom from outages or third-party interruptions
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Place2Stay, Let's Trade 1350CC, and their owners, employees, contractors, and agents are not liable for:
- inaccurate listings
- property defects or compliance failures
- user fraud or misrepresentation
- deposit, rent, payment, refund, or cancellation disputes
- lease disputes
- personal disappointment or business loss arising from a transaction
- indirect or consequential loss
Where liability cannot lawfully be excluded, Place2Stay's total aggregate liability is limited to the lesser of:
- the amount you paid to Place2Stay in the 12 months before the relevant event, or
- ZAR 5,000
This limitation does not override any rights that cannot lawfully be excluded.
11. INDEMNITY
You agree to indemnify and hold harmless Place2Stay, Let's Trade 1350CC, and their owners, employees, contractors, and agents against claims, damages, liabilities, costs, and expenses arising from:
- your use of the Platform
- your content or uploaded documents
- your listing activity
- your breach of law
- your breach of Place2Stay terms or policies
- disputes between you and other users
- your fraud, negligence, or misrepresentation
12. USER WARNING
Do not:
- sign a lease you do not understand
- pay a deposit before doing proper checks
- rely only on online wording, photos, or badges
- assume Place2Stay has physically inspected a property
Use normal caution and independent due diligence.
